The facts are stated in the opinion of the court. WASTE, C.J. By the former decision and judgment in this cause the respondent was directed to audit and allow the claim of petitioner as prayed for. The petition of the controller for a rehearing was granted because of his contention that the court had overlooked and failed to consider the decision of the District Court of Appeal in Brunson v. City of Santa Monica, 27 Cal. App. 89 [148 Pac. 950], and to permit further consideration to be given to the question of whether or not the title of the act in question (Stats. 1929, p. 565), adding a new section to the Civil Code to be numbered 1714 1/2, satisfies the requirements of section 24 of article IV of the Constitution wherein it is provided that ""Every act shall embrace but one subject, which subject shall be expressed in its title. But if any subject shall be embraced in an act which shall not be expressed in its title, such act shall be void only as to so much thereof as shall not be expressed in its title . . . .""
